Settling the estate of a loved one can feel overwhelming, especially while you’re in the midst of grieving. If your loved one’s Will designates you as Executor, you will need to submit their Will to the Probate Court and file a petition asking to be appointed Executor. After being appointed, you will be responsible for notifying others of your loved one’s death, gathering the estate’s assets, using the estate’s assets to pay the estate’s debts, filing certain legal documents, giving all legally required notices to the creditors, debtors, heirs and beneficiaries of the estate, and then eventually distributing the estate’s remaining assets to the beneficiaries named in the Will.

We will support you and your family by explaining how Probate works, answering your questions, preparing all required legal filings and notices, and guiding you through each step of the Probate process. Our goal is to help you settle your loved one’s affairs efficiently and with the least amount of stress to you and your family.

What happens if your loved one dies without a Will? You will need to petition the Probate Court asking to be appointed as Administrator of your loved one’s estate. An Administrator performs most of the same duties as an Executor. You will notify others of your loved one’s death, inventory the assets of the estate, use the estate’s assets to pay valid debts, file certain legal documents, and give all legally required notices to the creditors, debtors and heirs of the estate. Because your loved one died without a Will, Georgia law will determine who inherits. At the end of Probate, you will distribute the estate’s remaining assets to those people.
